Irish man lands in court after bad behaviour outside Kalgoorlie-Boulder nightclub

An Irish national has been fined after his behaviour outside a Kalgoorlie-Boulder nightclub prompted police to take him into custody and charge him.

Eamonn McGrath appeared in Kalgoorlie Magistrates Court on Monday charged with one count of remaining in the vicinity of licensed premises and one count of re-entering licensed premises within 24 hours of being required to leave.

Police prosecutor Sen. Const. Amy Southall told the court the 36-year-old man — who is living in Australia on a visa — became “argumentative” with police when they stepped in after he was refused entry to The Gold Bar nightclub on Hannan Street.

The incident took place shortly before midnight on a Wednesday night in May, with McGrath refusing to leave the area despite police instructions prompting them to issue him with a 24-hour order.

Sen. Const. Southall said McGrath “eventually” left only to enter the Exchange Hotel across the road a short time later, where police placed him under arrest.

Magistrate Janie Gibbs told the court a letter submitted to the court in McGrath’s support claimed he did not drink often but when he did he got “hyper”.

Ms Gibbs underscored that being drunk was no excuse but gave McGrath credit for his early pleas of guilty.

She handed him a total of $600 in fines and ordered him to pay $300 in court costs.

He was granted a spent conviction meaning the offences would not appear on most police records.
